We will not mince words: “eDiscovery” is a stain on our legal system. It drives up cost and risk. It is reactive. It destroys bandwidth. It invites malpractice. It clogs the pipes of justice. It obscures the truth. And it pads the pockets of vendors, to whom you write blank checks. It is so expensive that it has been weaponized to drive opposing parties into submission. eDiscovery is a black box that charges by the gig and by the page. It forces swift settlements, delays justice, cheats clients and enrages judges.
