U.S. Magistrate Judge Andrew Peck is once again making waves on the predictive coding front. Just last week, Judge Peck appointed Maura Grossman as “a special master in [ Rio Tinto v. Vale ] to assist with issues concerning Technology-Assisted Review (TAR), also known as predictive coding.” That a special master would be required to help the parties – where they entered into a predictive coding use protocol – seems counterintuitive and underscores the need for counsel to proceed with caution before agreeing to such protocols.
