A common refrain amongst e-discovery lawyers is that your first significant e-discovery matter will be the most expensive.

While there is some truth to that, the reasons why your first case will be expensive aren’t that readily apparent. While having lawyers that are experienced with e-discovery is important, their hands will be tied unless the client has taken steps to prepare for e-discovery. Despite the attention that e-discovery has received over the past 10 years, a lot of clients (and their law firms, for that matter) haven’t taken any proactive steps to prepare.
