While there are many elements that contribute to the cost of eDiscovery, it seems reasonable that if one can positively impact the amount of time required for eDiscovery, the number of people involved in eDiscovery, and the number of manual intervention points in the conduct of eDiscovery, one can decrease the overall cost of discovery. Although there are many ways to positively impact these elements, one of the newer ways is through the use of eDiscovery automation.

New, fourth-generation eDiscovery offerings that combine process and task automation can significantly lower the cost of eDiscovery to the point where litigation decision makers can now consider disputes that in the past may have been cost prohibitive to address. These newer tools, ranging from platforms like CloudNine to technologies like predictive coding, are creating new “reward-risk” balances as they lower the risk of addressing smaller disputes by lowering the cost of discovery.
